Hello everybody,
We are a team of designers running a free templates website –
http://www.themza.com. One of the software we are creating free themes for is 4Images. We are yet to become popular with our free 4Images themes, since we must admit, creating a theme for 4Images is not as easy as making themes for other popular software. Nevertheless, our first 4Images release – Photography Shot (
http://www.themza.com/4images/photography-shot-template.html) - did score a great success, becoming one of the most downloaded Themza templates within the first week of its release. The theme was even included in the “Recommended 4images templates and styles” section of the 4Images’ August Newsletter, which was, indeed, a great recognition for our work. It seems that the popularity of our
Photography Shot template has gone so far that some people are trying to present themselves as designers of the theme, thus infringing our copyrights over it. You can find the most shocking of such infringements here -
http://www.NO_TRAFIC_FOR_BAD_GUYS/themes/r-4images-templates-11-photography-shot-9.htm.
As you can see, this person is distributing our
Photography Shot theme under his online identity, without mentioning a word about Themza. This is in breach of our Terms of Use, where we say that:
“The Template User may not offer any of the Company's templates, modified or not, for redistribution or resale of any kind without prior written consent by the Company.”
In addition, this person has removed the two compulsory links to our websites that come along with the theme’s installation by default. This is another breach of our Terms of Use, where we explicitly state that:
“….the Template User agrees to preserve the links to the Company's websites, which are a part of the template itself.”
Well, as you can see, work ethic and loyalty do not seem to be necessary attributes on the World Wide Web nowadays. It is really sad how somebody is trying hard to create something useful and free of charge for the community, while somebody else is making use of his work without any respect and efforts.
How would you advise us to act in this situation? It may well be that this particular guy has stolen other themes from other websites as well, if we take into consideration the rich templates selection he is displaying on his own website. Any advice here will be highly appreciated.
