from what I know from my industry, if you make 10% changes on products its not anymore some one and you can remove all copyrights and place your own on it.
sometimes it's hard to find the 10% border but lawyer usually can help you ;)

Hello,

Well, it is time for the PhotoBox theme's authors to have a word here as well. From what we understand, we have here a 4Images user who is using our PhotoBox template as a basis for his websites and is even offering the theme as a download item to other users. There is nothing wrong with that to modify any of our templates to an extent that matches your demand perfectly well. There is nothing bad to distribute the theme to other 4Images fans either. We do take pleasure in knowing that people appreciate our efforts and are happy to use the results of our work on their own web pages. However, there are some rules of the game that do have to be kept in mind when you are involved in a two-side process such as using freely distributed stuff created by somebody else. We are so enthusiastic about creating professional quality yet FREE open source templates namely due to the fact that they can be used by many people without any restriction. All we want in return is that the two default bottom links are kept unchanged within the template’s layout, so that we could get some popularity credits for our works. That’s why actions like those when the default bottom links are modified and the themes – distributed without our explicit consent (as per our Terms of Use listed on our website) - are really demotivating and showing lack of respect for our work. After all, it is all about sticking to certain rules if we all want to be successful online. XPass, please read out our Terms of Use http://www.themza.com/terms.php (http://www.themza.com/terms.php) to learn how you should work with our 4Images themes. We'll be glad to have you as our user and even distributor as long as you observe our Terms of Use. That's it.
